Terms and Conditions

Article 1 – Definitions
In these terms and conditions, the following terms are defined as:

Entrepreneur: The owner of the webshop, Jerk Beefy Webshop, located in Ninove, registered with the Crossroads Bank for Enterprises under number BE 0801.253.553.

Customer: The natural person or legal entity entering into an agreement with the entrepreneur.

Agreement: Any purchase agreement concluded via the entrepreneur's webshop.

Right of Withdrawal: The possibility for the customer to withdraw from the agreement within the statutory period.

Article 2 – Applicability
These terms and conditions apply to all offers, orders, and agreements made via the entrepreneur's webshop.

Article 3 – Offers and Prices

All prices on the webshop are inclusive of VAT and exclusive of shipping costs unless otherwise stated.

The entrepreneur reserves the right to change prices and product information without prior notice.

In accordance with Belgian legislation, prices are clearly and transparently stated, without hidden fees.

Article 4 – Formation of the Agreement

An agreement is concluded when the customer places an order and receives an email confirmation.

The entrepreneur reserves the right to refuse an order.

Agreements are governed by Belgian law and the Law on Market Practices and Consumer Protection.

Article 5 – Payment

Payment must be made via the payment methods available in the webshop.

In case of late payment, the entrepreneur reserves the right to cancel the order.

The entrepreneur is obligated to provide a secure payment environment in accordance with Belgian electronic payment laws.

Article 6 – Delivery and Shipping

The entrepreneur will process orders with care and ship within the stated delivery time.

Delivery times are indicative, and exceeding them does not entitle the customer to compensation or cancellation.

In accordance with Belgian law, delivery must occur within a maximum period of 30 days, unless otherwise agreed.

Article 7 – Right of Withdrawal

The customer has the right to return the order within 14 days of receipt without providing a reason (in accordance with the Belgian Economic Law Code, Book VI).

The customer must notify the return in advance and return the product undamaged and in its original packaging.

A refund will be made within 14 days after receiving the returned goods via the same payment method used by the customer.

Article 8 – Warranty and Complaints

The entrepreneur guarantees that the delivered products meet the agreement and reasonable requirements of quality.

Complaints must be reported within a reasonable time after discovery via [email address].

Products are covered by the legal warranty period of 2 years, as defined in Belgian law.

Article 9 – Liability

The entrepreneur is not liable for indirect damages, consequential damages, or damages caused by improper use of the products.

The liability of the entrepreneur is limited to the invoice amount of the order in all cases.

Nothing in these terms excludes liability for willful misconduct or gross negligence by the entrepreneur.

Article 10 – Privacy Policy
The entrepreneur processes personal data in accordance with Belgian privacy laws and the General Data Protection Regulation (GDPR). For more information, please refer to the privacy policy on the webshop.

Article 11 – Applicable Law and Disputes

Belgian law applies to these terms and conditions.

Disputes will preferably be resolved through mutual agreement. If not possible, disputes can be submitted to the competent courts of the district where the entrepreneur is located.

The customer may also use the European ODR platform for online dispute resolution via https://ec.europa.eu/consumers/odr.
